A Seniors vs. Crime Consumer Protection Notice From
The Office of Attorney General Pam Bondi

(June 19, 2014)-  Contractor selection can be done by word of mouth and by checking the contractors rating with the Better Business Bureau, it should be an "A" rating. Schedule a system inspection with your servicing company. The contractor should clean coils, blowers, condensate drain pans, check electrical connections, electrical contacts and refrigerant level (as needed).

If your A/C system has been working and the service lech tells you that you need extensive repairs or a new system, don't be sold on an expensive repair until you get a second opinion!! Even if your system is not working, you should always get another opinion. If you have to stay in a hotel for a day or two to get another estimate, it could save you thousands of dollars.

Repairs and system replacements: Make sure you get a written estimate detailing work to be performed. Use the estimates to ensure that all work is performed. If you have questions about the estimate, call the contractor and ask your questions before work begins.

We sincerely hope that this will be aide to you and hopefully these guideline will save you money, time and aggravation. If you need our assistance, and are over the age of 55, please contact us at our Cape Coral Office.

Cape Coral Police Department Needs Your Help Identifying Check Fraud Suspects

(June 19, 2014)-  Cape Coral Police Detectives need your help identifying two check fraud suspects.

The owner of a local business in Cape Coral reported that his phone lines were intercepted and all his business calls were forwarded to a local phone number he did not recognize.  The suspects in the pictures above then cashed and attempted to cash two checks using the account number of his company at the BB&T branch locations at 1621 Cape Coral Pkwy. W. and 1321 SE 47th Ter., Cape Coral.   When the bank called the business number to verify the large checks could be cashed, the subjects intercepted the phone call, identified themselves as the owner, and gave authorization to cash the checks.

The account number used on the checks was stolen from the mailbox of a company in the North industrial park. The suspects provided identification as “William Pooler” and “Lisa Reed”; however, these are of course fake names/ID’s.

Please take a look at the pictures above.  If you have any information on the identity of the suspects, please contact the Cape Coral Police Department at 239-574-3223. You can also submit an anonymous tip. Go to www.capecops.com/tips or text a tip- text CCPD+"Your Message" to CRIMES (274637). Finally, you can call Crimestoppers at 1-800-780-TIPS.

Argument Over Money Owed for Bail Ends with Arrest

(June 25, 2014)-  Last night at around 9:30 PM, Cape Coral Police responded to a disturbance call at a barber shop located at 4515 Del Prado Boulevard S.

The victim, Geoff Mercado, advised police that he got into a verbal altercation with Marlen Barrios, over $3,000 that she and her husband paid to bail him out of jail.  Mercado was recently arrested (04-19-2014) by the Cape Coral Police Department for trafficking Heroin (CR# 14-006540).  Interestingly, Barrios was also recently arrested for trafficking Heroin, Possession of Drug Paraphernalia, and Child Neglect.

Mercado told officers  that during the argument he told Barrios that he would not be repaying the money to her or her husband.  According to Mercado, Barrios told him that he had two days to repay the money, "or else."

Things escalated quickly when, according to the victim and corroborating witnesses, Barrios placed her car in reverse and attempted to strike Mercado with her vehicle as he walked away from her.  Mercado had to run to get out of the way of the vehicle.  Barrios then left the business driving north on Del Prado Boulevard.

Officers made contact with Barrios on a traffic stop a couple of blocks from her home.  During a post-Miranda interview, Barrios denied making a threat, but did say that she gave Mercado a two-day repayment window.  Barrios also claimed that she did not see Mercado when she was backing up (even though she was never in a parking space and had no reason to back up in order to exit the parking lot).

Barrios was arrested for Attempted Aggravated Battery and was transported to Lee County Jail.

Traffic Stop Leads to Arrests for Trafficking Heroin, Possession of Firearm by Convicted Felon

(June 30, 2014)- Cape Coral Police arrested a couple on charges of trafficking Heroin and Possession of a Firearm by a Convicted Felon, following a traffic stop for a seatbelt violation on Saturday evening.

Around 7:30 PM, Officer Carson observed a green Honda 2-door driving southbound on Del Prado Boulevard, and saw that the front passenger was not wearing his seatbelt.  The officer conducted a traffic stop shortly after the vehicle turned off of Del Prado, onto Coronado Parkway.

Cape Coral Police Department K9 Officer McCreary and his partner 'Nate' responded to the stop.  An open-air sniff of the car resulted in K9 Nate alerting to the presence of narcotics.  The occupants of the car were removed from the car and detained.  They were read their rights and a narcotics investigation was started.  The driver, Chrissie Simmons,  objected to the search of her car, claiming that "the dog always alerts on their vehicle and the police never find anything."

During the search of the vehicle, a small backpack was located behind the front seats.  inside the backpack was a loaded Smith and Wesson 9mm handgun, a tube sock containing another loaded magazine for the gun, and a tube sock containing 9mm ammunition (90 rounds total), along with men's clothing and paperwork belonging to the front passenger, Matthew Simmons.  The investigation revealed that Simmons is a convicted felon.  Simmons denied that the weapon was his, claiming that it belonged to his wife, though his fingerprints would be on it because he shoots it at the gun range.

Officers also found numerous clear plastic baggies containing a whitish powder concealed within the trunk.  A field test of the powder showed a positive result for Heroin.  The suspect Heroin (total weight of 15.1 grams) was seized as evidence.  Both denied knowledge of the Heroin, though when asked about the car they stated that they drive the car exclusively.

Officers also located a black box containing bundles of cash in small denominations, totaling $4246.00.  K9 Nate also alerted to the presence of narcotics on the cash.  During the course of the investigation, the Simmons' stated that neither had been employed for over three months.  When asked about the cash, they claimed it was from their tax return. The bundling, the proximity to the firearm, and the location of heroin nearby gave officers probable cause to believe the money was the ill-gotten gains of narcotics sales and it was also seized as evidence.

Both were arrested and transported to Lee County Jail.

ARRESTED:  Matthew T. Simmons, B/M 05-05-1988, of 1080 Hancock Creek Blvd., Cape Coral
CHARGES:  Trafficking Heroin, Possession of firearm by convicted felon.

ARRESTED:  Chrissie Simmons, W/F 12-03-1989, of 1080 Hancock Creek Blvd., Cape Coral

A Shoplifting Investigation Yields Narcotics, Burglary Spoils

(July 4, 2014)-  yesterday at around 8:0 PM, Cape Coral Police  responded to Publix located at 127 Cape Coral Parkway W., on a retail theft.  While en route, dispatch advised that a female was in the store and possibly stealing items, and that there were two males sitting in a blue Chevrolet Cavalier in the parking lot, waiting for the female.

As Officer Kortright Arrived, he saw a female (Tufano) standing near a blue Chevrolet Cavalier, speaking with loss prevention.  When Tufano saw Officers arrive, she handed over a piece of stolen merchandise then ran, ignoring all commands to stop.  After a brief foot pursuit, she was taken into custody.

he driver of the vehicle (Neidigh) ignored Officer Kortright's order not to move, and attempted to flee the area.  Officers Gray and Buonocore, who were in the area, located the vehicle and conducted a traffic stop at SW 46th Terrace and Pelican Boulevard.

Tufano was placed under arrest for Retail Theft and Resisting an Officer without Violence.  During a search of her person, a small black zipper bag in the purse she was carrying was located that contained several unused syringes and one syringe which had a dark liquid inside of it.  In addition, a spoon with a piece of cotton swab, a piece of Brillo, and a clear glass pipe were also located in the bag. On 07-10-2014 at approximately 21:10 PM, Cape Coral Police were dispatched to a report of a vehicle that was attempting to stop another vehicle by impersonating a police officer.  Officers responded to the area of Chiquita Blvd N. near Tropicana Blvd W.  The caller was on the phone with CCPD dispatch and was providing updated information while the event was ongoing.

The caller advised Cape Coral Police Department dispatch that a vehicle was behind him flashing it's high beams and flashing a red / blue light across the front windshield.  The caller  stated that he was SB on Chiquita Blvd N. from Kismet Blvd. when this event started.

The caller stated as he was southbound, he observed a vehicle behind him with red / blue lights on the front windshield.  The caller stated that he began to slow because he believed he was being stopped by an unmarked police car.  The caller stated that as the vehicle got closer to his vehicle's rear, he realized that it was in fact a Nissan Altima.  The caller  stated that he recognized the make of the vehicle because he owns one as well.  The caller  stated that he was unsure if it was a police vehicle at that time., so he called 9-11.  The caller  stated that as the Nissan passed him on his left that the red / blue lights went from the windshield to the window of the passenger side front.  The caller was able to provide a license plate number to the operator.

Responding officers observed the suspect vehicle make a moving violation and initiated a traffic stop.  The investigation revealed that the Driver (Angel Torres Jr., W/M, DOB: 03-24-1997 of 2731 NW 3rd St., Cape Coral) and the front seat passenger (Christian Jose Iturbe, W/M, DOB: 06-25-1998, of 612 Wilmington Parkway, Cape Coral, FL) by using a combination of flashing the car's high beams and using a Youtube video of flashing red and blue lights on Iturbe's cell phone.

ARRESTED:  Angel Torres Jr., W/M, 17 YOA, of 2731 NW 3rd St., Cape Coral
CHARGES:  Impersonating a law Enforcement Officer

ARRESTED:  Christian Jose Iturbe, W/M, 16 YOA, of 612 Wilmington Parkway, Cape Coral, FL.
CHARGES:  Impersonating a Law Enforcement Officer

"While this particular case looks to be a criminally stupid prank, cases like this can be scary and potentially very dangerous.  In this situation, the victim was suspicious that the 'police car' was real and did exactly the right thing- called 9-11.  Impersonators can have dangerous motives for trying to stop members of the public, and impersonators like this shake public confidence and make people second guess real police officers conducting legitimate law enforcement duties."- Det. Sergeant Dana Coston, Cape Coral Police Department Public Affairs Officer.

Here are some tips (original article):

  1. Observe. Take a good look behind you, especially if you are both turning a corner. If the flashing lights match those that you know are used by the local crime fighters, than you may feel more comfortable with stopping. Some agencies use all blue, some red and blue, some only red, while others may have some other color combination. If your local constabulary uses only blue and you see someone trying to stop with you green strobe lights, that could be a clue that they may not be for real.  When you turn the corner, can you see identifiable markings on the side of the car in your rear view mirror. While unmarked units can conduct traffic stops in many jurisdictions, some departments require that they be conducted only by marked cars.
  2. Signal. Let the officer know that you realize that they are attempting to make the traffic stop. Many officers get nervous when cars do not stop when signalled to do so. They fear that the person may be getting or hiding a gun, getting rid of drugs or other evidence, or just thinking of what their next move should be. Put on your hazard lights and, if it's dark, put on your interior dome light so the officer behind you can see that you are not making those dreaded "furtive movements" for a gun.
  3. Call. Pick up your cell phone and call 911. Almost all police officers, deputy sheriffs, and state troopers are required to call their communications center on the radio when conducting a traffic stop.
  4. While officers get concerned if you fail to stop right away, both their radio transmissions and your call to 911 are recorded and can show that you were wanting to stop in good faith. You may be able to demonstrate that you were seeking verification before doing so. This is particularly understandable to the authorities if you are a woman travelling alone on that lonely highway late at night. However, that won't work if you take an prolonged period of time to do so.
  5. When talking to the 911 operator, give your location, your name, and vehicle description. Ask if a law enforcement officer is known to be stopping a car matching your information.
  6. Drive. Head to a well-lit, populated area such as a mall parking lot or 24 hour gas station. Heading to the local police sub-station does not always work late at night as many rural facilities are not manned after business hours.
  7. Ask. In a very respectful manner, ask the law enforcer that approaches your car door for identification. In addition to the badge, all officials have a photo ID card that clearly identifies them and the agency from which they derive their authority. When in doubt, politely explain your concerns and ask for a supervisor.

"Routine" Call  Call Turns Into Officers Battered; Suspect Arrested

(July 14, 2014)-  What began as a suspicious vehicle call in the early morning hours of June 29th, turned into an arrest for drugs and Battery on a Law Enforcement Officer.

Travis Robey, W/M, DOB: 08-01-1993, of 1912 Tropicana Parkway W., Cape Coral was arrested on charges of Battery on a Law Enforcement Officer, Resisting With Violence, Possession of Marijuana, and Possession of Drug Paraphernalia.

At around 3:30 AM, Cape Coral Police responded to a call of a suspicious vehicle in the parking lot of BA Hustlers, located at 2138 Santa Barbara Boulevard.  Initially, officers were advised of a male sitting in the vehicle.  However, while en route, Officers were advised that the male was standing outside of his vehicle, punching and hitting it.

When officers arrived, they made contact with an intoxicated Robey, who was standing by the open driver's side door of a white pickup.   When asked why he was in the parking lot at this hour, Robey explained that his girlfriend is a waitress at Hustlers and he was waiting for her.  As on of the responding officers went inside to confirm this, Robey stated, "Officer, I know I'm not 21, but nobody inside hustlers served me alcohol."  Officers confirmed that Robey was in fact the boyfriend of an employee, and she was aware that he was outside because he was too young to drink inside.

At the truck, officers were able to smell the odor of raw cannabis coming from the vehicle.  Looking inside, Officers were able to see, in plain view, a small amount of suspect cannabis.  Robey was read his Miranda Warning from a pre-printed card.  Robey initially agreed to speak with officers.  However, once officers attempted to detain him for the purposes of the narcotics investigation, Robey began to verbally and physically resist.

Robey shouted at Officers, "I'm not detained." and pulled away from officers who were attempting to place him in handcuffs.  Despite repeated verbal commands form officers, Robey continued pulling away from Officers attempts to handcuff him.  An officer at the scene deployed their Taser, but it was ineffective and Robey managed to pull away and flee on foot.

As the foot chase continued westbound toward SW Santa Barbara Place, Officers managed to take Robey to the ground.  Robey then became aggressive toward officers, punching one Officer in the head above his ear.  That officer attempted to deploy his Taser, but the probes did not connect, Robey then struck the officer again, knocking the Taser from the Officer's hand.  Another officer deployed their baton, striking Robey in the buttock, in an attempt to gain compliance, knocking him to the ground.

Despite repeated verbal commands and attempts by officers to take Robey into custody, he still continued to resist, punching and fighting with officers.  Robey head-butted an Officer and once again managed to break free and continue running, this time, northbound.  A pursuing officer managed to get Robey back to the ground, but only briefly.  Robey got up and began swinging at Officers.  This time, Officers attempted to use OC spray to gain compliance, but it was ineffective and Robey continued to swing at officers.  Finally, an officer was able to strike Robey in the leg with his baton, get Robey to the ground, and with the help of other officers, get Robey into handcuffs.

Robey was searched, photographed, and secured in the rear of a patrol car.  The suspect cannabis from his vehicle was seized and field tested positive for THC.  Robey was transported to Cape Coral Hospital to be medically cleared, then later to Lee County Jail.
