UPDATE: Cape Coral Police Detectives Release Names of Subjects in Wednesday Afternoon Shooting

(June 2, 2016)- Cape Coral Police Detectives are able to release the names of the involved persons from a shooting that took place around 4:30 PM yesterday in a SE Cape Coral Coral neighborhood that left one person dead.

The deceased is identified as Victoria Brown, W/F, 58 years old, of 2933 SE 8 Pl., Cape Coral.  Detectives detained and questioned her husband, Vernon Brown, Jr., W/M, 58 years old, also of 2933 SE 8 Pl., Cape Coral.  At the conclusion of the questioning, Mr. Brown left with other family members.

Cape Coral Police Detectives have obtained a search warrant for the residence and are in the process of serving it.  The investigation is ongoing.  Additional updates will be provided as information becomes available.

Cape Coral Police Investigating Hit and Run; One Hospitalized

(June 5, 2016)-  Cape Coral Police Department are working a hit and run in NW Cape Coral that has sent one person to the hospital in critical condition.

At around 1:00 AM, Cape Coral Police responded to a unknown problem in reference to a male found lying on the roadway with severe injuries in the 1700 block of NW 18th Terrace. The male was trauma alerted to a local hospital. Major Crash Investigator responded to take over the investigation.  Forensics personnel and Victim Advocates responded to assist.

The name of the injured subject is being withheld pending notification of next-of-kin.

Video surveillance from a nearby home picked up a light colored KIA soul driving in the area around the time of the accident. The below picture is of a similar vehicle. The black rubber cladding found on the doors of this KIA were also very noticeable on the suspect vehicle. This is a feature that is not on the brand new KIA Souls currently on the lot a Fuccillo Kia.  Major Crash Investigators believe the suspect vehicle will have front-end damage near the passenger side.

UPDATE: Victim in Overnight Hit and Run Identified

(June 5, 2016)-  Cape Coral Police Major Crash Investigator has released the name of the victim in a hit and run crash that occurred last night.

The preliminary synopsis of the Major Crash Investigator is below:

DATE: June 5, 2016
TIME: 12:59 AM
LOCATION: 1700 block NW 18 Terrace
CR#: 16-009089
ASSIGNED MCI: M/Cpl. Andrew Satterlee

VEHICLE 1: Light color (white/silver) Kia Soul, unknown tag.

PEDESTRIAN: Michael Christian Park, W/M, 18, of Cape Coral, Florida.
PEDESTRIAN INJURIES: Park suffered life threatening injuries.

SYNOPSIS: A Pedestrian, Michael Park, was walking east on NW 18 Terrace.  A vehicle traveled east on the same street and struck the Pedestrian.  The vehicle then left the area.  A person driving by located the Pedestrian lying in the roadway and called 9-1-1.  Park was transported by ambulance to a local hospital with life threatening injuries, where he currently remains.  Cape Coral Police received the traffic crash call at 12:59 AM, but the crash appears to have happened between 11:PM and 12:30 AM.

Major Crash Investigator Satterlee, Forensics personnel, and Victims Advocate Lucas responded.  The next of kin HAS BEEN notified.  It is unknown if this traffic crash was alcohol/drug related.  A criminal investigation is ongoing.

Video surveillance of the street shows a light in color Kia Soul travel East on NW 18 Terrace and interact directly in the area where the Pedestrian was walking.  The vehicle has possible damage to the right front/side of the vehicle with possible hood damage.

Results of 6th High Visibility DUI Enforcement Operation

(June 5, 2016)-  Last night, the Cape Coral Police Department Traffic Unit conducted its sixth High Visibility Enforcement (HVE) DUI Operation since being awarded a grant from the Florida Department of Transportation (FDOT) in the later part of 2015.

The operation was a saturation patrol that was conducted city-wide.  Officers were focused on identifying and taking impaired drivers off the road.  Below are the results of this operation:

Jones stopped a vehicle for failing to yield the right of way to a pedestrian.  K-9 Officer Gugliotta responded as a back up unit and conducted a free air sniff of Mantell’s vehicle.  K-9 Oz alerted to the presence of narcotics in the vehicle.  A bag of marijuana was found under the front passenger seat.  Mantell admitted to being the owner of the marijuana post Miranda.  NTA issued.

Joslynwas stopped for failing to maintain a single lane.  After speaking with Joslyn, Ofc. Gray saw signs of impairment and requested Joslyn to complete field sobriety exercises, which he did.  At the completion, Ofc. Gray asked Joslyn to give breath samples which he did. (.000 and .000)  Cpl. Fessel asked Joslyn to complete a drug influence evaluation and submit to a urine test.  Joslyn refused.

Caetano was stopped for failing to maintain a single lane and tinted taillight covers.  After stopping the vehicle K-9 Officer Gugliotta backed up Cpl. Fessel.  After conducting and open air sniff, K-9 Oz alerted to the vehicle.  After searching the car 478.65 grams of marijuana and paraphernalia was found.

Perez was stopped for driving 57 mph in a 40 mph zone in the 1900 block of Country Club Blvd. After speaking with Perez, Mcpl. Satterlee smelled the odor of marijuana coming from the vehicle.  Perez told Mcpl. Satterlee that she and a friend had smoked marijuana earlier.  Mcpl. Satterlee conducted a narcotics investigation.  After having Perez exit her vehicle, Mcpl. Satterlee and Ofc. Handley found marijuana, crack cocaine and a marijuana pipe.

Stella was stopped after making a u-turn at SE 46th Lane and Del Prado Blvd.  During the u-turn, Stella drove up on the sidewalk and continued for approximately 15 feet before driving back on the roadway.  After stopping the vehicle, Det. Jones spoke with the driver, Stella.  Stella had a plastic bag sticking out of chest/shirt area with what looked like crack cocaine.  After being told that she had a lot of crack in the bag, Det. Jones began a narcotics investigation.  She was arrested with 12.1 grams of crack cocaine.  She was also charged with DUI.  After blowing .016 and .016, Stella was asked to complete a drug influence evaluation.  Stella refused.

Cape Coral Police Department Investigating Multiple Shootings; 2 Dead, 3 Injured, Suspect Dead

(June 5, 2016)-  This afternoon around 5:44 PM, Cape Coral Police Department respopnded to a shooting call in the 2600 block of Skyline Boulevard.

Upon arrival Officers discovered that a motorcyclist suffered a fatal gunshot wound.  The motorcyclist was pronounced dead at the scene.

While working the initial shooting, a second shooting call came in to Cape Coral Police Departmentat 6:28 PM at the Circle K located at the intersection of Chiquita Boulevard and Cape Coral Parkway W.

Officers arrived to discover that one person in the store sustained a fatal gunshot wound and another person sustained a non-life-threatening gunshot wound.

Officers located the suspect approximately 4 minutes later at the intersection of Skyline Boulevard and Cape Coral Parkway W.  Officers stopped the vehicle near the 5100 block of Skyline Boulevard.  The suspect was still armed and violently resisting Officers as multiple Officers engaged him.

The suspect was pronounced dead at the scene.  There were two passengers in the car with the suspect, both of whom sustained injuries.  Both were transported to a local hospital for treatment.

The scene at 2600 Skyline has been processed and cleared.

Officers, Detectives, Forensics personnel and Victim Advocates are still assisting at the remaining scenes.

No names are being released at this time, pending notification of next of kin of the victims and the suspect.

This is still a very active and fluid investigation.  Additional information will be forthcoming as it becomes available.

UPDATE: Cape Coral Police Detectives Release Identity of Shooter

(June 6, 2016)-  Cape Coral Police Detectives have released the name of the shooter in yesterday's multiple shooting incident.

Detectives have identified the shooter as Christopher Michael Moran, W/M, DOB: 11-19-1984, of 901 SE 8th Terrace #6, Cape Coral, Florida.

Additional information will be provided as information becomes available.

"Good evening everyone,

As you know, yesterday afternoon, Cape Coral experienced a terrible tragedy that resulted in the death of two people and the injury of three others as the result of the heinous actions of a gunman; a gunman who was only stopped by the courageous actions of several members of the Cape Coral Police Department.

Your Police Department is working this case tirelessly, collecting evidence, conducting interviews, and processing the three crime scenes.  Part of the work following such tragic events is to make proper notification to the next of kin and provide the survivors services and assistance through our Victim Assistance Unit.  This is currently underway.  Sometimes relatives are identified and located in the area and this work is fairly quick.  Other times, relatives can be harder to locate and may not be in the area.

We must remember the human element in tragedies where lives have been lost or at a minimum, changed forever by injury or loss.  Empathy for the suffering of the survivors is not just a luxury, it is good community-oriented policing.  Once these notifications are made, or once all avenues have been exhausted, we will provide detailed releases with this information.  As this investigation progresses and we are able to do so, updated news releases will be posted to www.capecops.com/newsroom and will be shared via social media (links below) and with our media partners.

In the meantime, we have seen a number of reports and posts on social media from members of the media and citizens.  While well-meaning, many contain inaccurate and incomplete information.  We understand the desire to try to fill in the gaps to make sense of a senseless catastrophe.  However, we cannot urge citizens and our media partners enough to please refrain from engaging in speculation.  We want to minimize confusion, and make sure that our citizens are given the best information possible, as quickly as the investigative process will allow."-Det. Cape Coral Police Department Concludes Second Wave of Bike-Ped Operations; Crashes Down 10%

(June 7, 2016)-  The Cape Coral Police Department Traffic Unit efforts helped reduce Bicycle/Pedestrian crashes by 10% year over year, according to the numbers.

The Cape Coral Police Department just completed the second wave of our Grant Funded High Visibility Pedestrian/Bicycle Enforcement.  The goal of the wave was to make the streets safer for those cycling and running/walking throughout the city.  The enforcement wave ran from November 30, 2015 to May 31, 2016.  The focus for this wave was areas within the city where we saw the most pedestrian/bicycle traffic crashes.

This wave had the following results:

  • 509 Hours Worked
  • 363 Contacts
  •  Bicyclists: 133 Warnings, 30 Citations
  • Pedestrians: 29 Warnings, 3 Citations
  • Motorists: 98 Warnings, 70 Citations

The result of this wave was a 10% decrease in Pedestrian/Bicycle Traffic Crashes during the time period versus last year.

  • 30 November 2015 – 31 May 2016: 64 traffic crashes
  • 30 November 2014 – 31 May 2015: 71 traffic crashes

"There is still a great need for the youth of Cape Coral to wear bicycle helmets and to have their bicycles equipped with brakes.  Those riding at night need to have bicycle lights (front and rear) and are encouraged to wear high visibility clothing.  "- Sergeant Jon Kulko, Cape Coral Police Department Traffic Unit.

(June 7, 2016)-  Cape Coral Police Major Crash Investigators are still looking for a suspect in a June 5th hit and run crash that hospitalized  one person.

Video surveillance of the street shows a light in color Kia Soul travel East on NW 18 Terrace and interact directly in the area where the Pedestrian was walking.  The vehicle has possible damage to the right front/side of the vehicle with possible hood damage.  The Major Crash Investigator has obtained still images from the surveillance video.

UPDATE: Cape Coral Police Detectives Release Names of Victims in Sunday Shootings

(June 8, 2016)-  Cape Coral Police Detectives have released the name of the victims in Sunday's multiple shooting incident.

Detectives have identified the motorcyclist who was gunned down in the 2600 block of Skyline Boulevard S., as Jeremy C. Taylor, W/M, 54, of Cape Coral.

Sean Strickland, W/M, 26, of Cape Coral, was identified by Detectives as the employee at the Circle K located at 1603 Cape Coral Parkway W, who was shot and killed by the suspect.

Richard Huwiler, W/M, 61, of Cape Coral was a store patron at the same Circle K store who sustained a non-life-threatening gunshot wound.

Detectives have also identified the two passengers in the suspect vehicle as Maria A. Rodriguez, W/F, 32 and Christopher Moran, Jr., 14 months; both also of Cape Coral.  Both are still hospitalized at this time.

Next of kin have been notified in each of these cases.

The investigation is ongoing.  Additional updates will be provided as information becomes available.

Public Notice: Cape Coral Police Department Applies for Justice Assistance Grant

(June 9, 2016)-  The Cape Coral Police Department is in the process of applying for the Edward Byrne Memorial Justice Assistance Grant Program FY 2016 local solicitation through the U.S. Department of Justice.

One of the requirements of the grant is that the governing body as well as the public is notified 30 days prior to the submission of the grant.  Only eligible units of government listed on the U.S. Department of Justice website are able to apply for funding.  The City of Cape Coral is eligible to receive $17,219, to be used during Fiscal Year 2017.  The Justice Assistance Grant Program provides critical funding necessary to support a range of program areas, including law enforcement.  Funds may be used for local initiatives that will improve or enhance law enforcement programs and services.

UPDATE: Suspect in Strange Abduction Case Takes Plea

(June 9, 2016)- A suspect in a bizarre 2015 abduction case pled to several charges yesterday.

Kristina Pantalias was arrested back in May of 2015 after stealing a car, abducting her niece and nephew, and taking them to an apartment in Fort Myers where her niece was mauled by a dog.

In an unexpected turn of events yesterday at a scheduled Child Hearsay Motion, the defendant pled.

Kristina Pantalias, W/F, DOB: 06-30-1985, of 2811 SE 15th Place #102 Cape Coral FL pled to the following 8 charges: Interference With Custody (2 counts), Grand Theft, Aggravated Child Neglect, Possession of Heroin, Possession of Controlled Substance (2 counts), and Child Abuse.

Kristina Pantalias, W/F, DOB: 06-30-1985, of 2811 SE 15th Place #102 Cape Coral FL pled to the following 8 charges: Interference With Custody (2 counts), Grand Theft, Aggravated Child Neglect, Possession of Heroin, Possession of Controlled Substance (2 counts), and Child Abuse.

Kristina Pantalias pled to the following 8 charges:

  • Interference With Custody (2 counts)
  • Grand Theft
  • Aggravated Child Neglect
  • Possession of Heroin
  • Possession of Controlled Substance (2 counts)
  • Child Abuse

Pantalias pled to 70.35 months (5yrs 10mo) in DOC followed by 8 years probation.  Pantalias has been incarcerated at the Lee County Jail since her initial arrest on May 12, 2015.

According to Detectives, the children are both doing well, and the child mauled by dog is still getting medical treatment for her injuries.

Join Interim Chief Dave Newlan for a Town Hall Workshop

(June 15, 2016)-  The Cape Coral Police Department would like to invite citizens to join us for a fun, engaging, and informative evening where your input will help shape the future of the Department.

Join Cape Coral Interim Police Chief Dave Newlan for a town hall workshop on Wednesday, June 29, 2016 from 6:30 PM to 8:00 PM at the Westin Cape Coral Resort (Calusa Room), located at 5951 Silver King Blvd., here in Cape Coral. 

Attendees will be broken out into three groups and will rotate through a series of three 10-minute, dynamic, interactive sessions, headed by the Chief and members of the Command Staff.  The sessions will cover:

  • Property Crime-  Taking Aim at Vehicle Burglaries with "Lock It or Lose It"
  • Tackling Traffic- Making our Roads Safer
  • Taking the Pulse of the Community- Open Brainstorming Session

The workshop will be followed by a Q&A session where citizens are invited to ask questions about the state of the Cape Coral Police Department, crime, quality of life issues, and more. Members of the Command Staff, District Resource Coordinators (DRCs), and Public Affairs Officer (PAO) will be on hand to help answer your questions.

UPDATE: Condition of Passengers in Suspect Vehicle from Sunday's Multiple Shooting

(June 16, 2016)-  Cape Coral Police want to provide an update regarding the condition of the passengers that were inside the suspect vehicle.

32 year-old Maria A. Rodriguez and Christopher Moran, Jr have both been released from the hospital and are in good condition.

UPDATE: Number of Officers Involved in Cape Coral Shooting Released

(June 20, 2016)-  Cape Coral Police want to provide an update regarding the police officers involved in the June 5, 2016, active shooter incident that claimed the lives of Jeremy C. Taylor, 54 and Sean Strickland, 26, both of Cape Coral.

Cape Coral Police confirm that four officers were involved in the high-risk traffic stop and subsequent violent encounter that resulted in the death of the shooter. None of the involved officers were injured in the confrontation with the suspect.  All four are currently on administrative duty, which is standard procedure in officer-involved shootings.

The investigation is ongoing.  Additional updates will be provided as information becomes available.

"We are happy to report that the officers are doing well and are back to work on administrative duty.  Once the criminal investigations are concluded, the Professional Standards Bureau of the Cape Coral Police Department will conduct an administrative review of the shooting.  This is standard procedure in all officer-involved shootings," Det. ANNOUNCEMENT: Neighborhood Watch Quarterly General Membership Meeting

There will be a short general business meeting and an opportunity to discuss individual neighborhood concerns with members of the Cape Coral Police Department. A representative from Lee County Domestic Animal Services will be the guest speaker.

Cape Coral Police Department Announces "Community Face-to-Face" Program

(June 24, 2016)-  The next time the police come knocking, it may be for a good reason!  Next week, the Cape Coral Police Department will begin its new “Community Face to Face Program.”  

Starting next week, Interim Chief Dave Newlan and a small group of officers will go door-to-door in residential neighborhoods and business areas, meeting residents, visitors, business owners, and employees in person for the purpose of building relationships between citizens and police, exchanging information, and starting conversations.  Different locations throughout the city will be visited monthly.

“Some people never have contact with a police officer unless they are having a problem.  Many others can’t make it to community meetings or police events because of work, school, or other obligations.  Community Face-to-Face allows us to talk with citizens on their turf and on their terms,” said Interim Police Chief Dave Newlan, Cape Coral Police Department.  “This is Community Policing 101.  Our officers get out of their cars and talk to people as much as they can during a shift, but this is a chance for me to hear directly from people what’s happening in our city, get feedback, and just get to know the citizens we serve."

"Community Face-to-Face" is a continuation of the Cape Coral Police Department’s Community Engagement Program which includes things like Shop With a Cop, Social Media Program, Coffee With a Cop, and Chief’s Town Hall.

The first Community Face-to-Face will be held on July 1, 2016, along the Pine Island Road corridor.

Cape Coral Police Investigating Multi-Car Fatality Crash That Shut Down Veterans Parkway Last Night

(June 28, 2016)-  Cape Coral Police are investigating a fatality crash that had Veterans Memorial Parkway shut down for several hours last night.

At around 6:40 PM, Cape Coral Police responded to a 4 car traffic crash at Veterans Parkway and Country Club Boulevard. A driver, who was traveling westbound on Veterans Parkway, experienced an apparent medical event and drove over the median and into another vehicle that was traveling eastbound. Two other vehicles collided from the crash. Several occupants were injured and one of the drivers died from the injuries he sustained. Major Crash Investigators Satterlee and Gray responded to the scene to conduct a Major Crash Investigation.  Forensic personnel processed the scene. A Victim Advocate responded to assist with the families involved.

DRIVER 2: Jose Abraham Nieves, H/M, 52, of Cape Coral, Florida.
DRIVER 2 INJURIES: Nieves died at the hospital due to injuries suffered in the traffic crash.

VEHICLE 3: Black 2015 Ford 4 door car.
DRIVER 3: Steven Scott Pawlowski, W/M, 50, of Cape Coral, Florida.
DRIVER 3 INJURIES: Pawloski suffered no injuries in the crash.

PASSENGER 2: Marc Louis Jean, 22, of Lehigh Acres, Florida.

SYNOPSIS: Vehicle 1 was west on Veterans Memorial Parkway in the left hand turn lane approaching the intersection with Country Club Boulevard. Vehicle 2 was east on Veterans Memorial Parkway in the left hand lane. Vehicle 1 crossed over the center median and into the eastbound inside lane, where the front of Vehicle 1 struck the front of Vehicle 2. Vehicle 2 came to rest in the roadway. Vehicle 1 then spun and crossed back over the median and struck Vehicle 3 who was stopped in the inside south turn lane. Vehicle 1 continued west where the rear of Vehicle 1 struck the front of Vehicle 4 and came to rest in the inside east lane of Veterans Memorial Parkway.  

The driver of Vehicle 1 and Vehicle 2 were trauma alerted to a local hospital with life threatening injuries. The driver of Vehicle 1 is listed in critical but stable condition.  The driver of Vehicle 2 died at the hospital due to injuries suffered in the crash.

MCI Officers Satterlee and D. Gray, Forensic personnel, and Victim Advocate responded.  The next-of-kins HAVE BEEN contacted.  This traffic crash IS NOT alcohol/drug related.  Veterans Memorial Parkway was shut down for several hours. Case pending Traffic Homicide Investigation.

***There are 5 traffic fatalities and 17 MCI usages in our city in 2016. (There are 0 fatalities that are ruled "medical" and the cause of death is not related to injuries in the traffic crash. These 0 "medical" fatalities are not included in the number of traffic fatalities).***

Detective Resigns Amid Allegations

(June 29, 2016)- A Cape Coral Police Detective has resigned following startling allegations of deceiving the Cape Coral Police Department.

Kordelle McKissack, resigned from the Cape Coral Police Department today.  Information came to light during a court proceeding yesterday and was provided to the Cape Coral Police Department that McKissack allegedly lied during the employment process with the department 13 years ago.  McKissack denied being under investigation on an official form during his application for employment with the Cape Coral Police Department.  Information revealed in court yesterday showed that he was under investigation for an allegation of sexual battery at the time of his application with the Cape Coral Police Department in 2003.

“When we received the information yesterday, I immediately directed the Professional Standards Bureau to open an Internal Affairs investigation into this matter.  I was informed today that Detective McKissack opted to resign from the department.  In spite of this turn of events, the investigation will go forward to completion and the results will be forwarded to the Florida Department of Law Enforcement Criminal Justice Standards and Training Commission (CJSTC),” said Interim Chief Dave Newlan.

The Criminal Justice Standards and Training Commission is the body that certifies police officers in the state of Florida.  Moral character violations, such as lying or perjury, can be grounds for de-certification.

“We go to great lengths to vet potential police officers.  Each applicant must complete pre-employment testing, go through a panel interview, satisfactorily complete a background check, and are subjected to a polygraph, drug screen, and psychological evaluation. Fewer than 10% of applicants make it through.  In this case, the allegation of sexual battery was not disclosed by either Detective McKissack or his former employer,” according to Newlan.  The Internal Affairs investigation will show what occurred definitively.

Background investigators with the Cape Coral Police Department conduct extensive employment and reference checks on sworn and civilian employees as well as volunteers. This process can take several months to complete, especially if candidates or their references are out of the area.  Interim Chief Newlan continued, “The Cape Coral Police Department was never provided with derogatory information pertaining to Kordelle McKissack, by his former employer, the Spring Hill Police Department in Spring Hill, Tennessee.  In fact, their past Chief of Police, Reggie Pope, provided a very positive letter of recommendation.  If the facts of the Internal Affairs investigation support what was alleged to have been happening at the time, this was patently deceptive on the part of Pope.”

McKissack had been on administrative leave since March 7, 2016 pending the completion of a separate Internal Affairs investigation pertaining to allegations of untruthfulness as the affiant in a search warrant in a criminal investigation.  This investigation is still pending and will be completed and forwarded to FDLE and the CJSTC as well.

“We hold ourselves to the highest standards of professional conduct here at the Cape Coral Police Department. We will continue to do everything necessary to maintain the public trust we have worked so hard to earn,” Interim Chief Dave Newlan, Cape Coral Police Department.

Cape Coral Police Department and State Attorney Conclude Officer-Involved Shooting Justified

(June 30, 2016)-  Reviews by the Cape Coral Police Department and the State Attorney’s Office into an officer-involved shooting that occurred back on October 24, 2015, have been concluded, finding the Officer’s actions justified.

The October 24th incident began as a domestic disturbance at 1518 NE 43 Ln., Rolly Thomas, 34 came to the residence where his estranged girlfriend and mother of his children, Marsha Alexander lived with their children.  Thomas was not living at the residence and Alexander had an active injunction for domestic violence and a no contact order in place against Thomas.  Thomas came to the residence and dropped off one of his children, in violation of the order.  Cape Coral Police Department responded, but Thomas left prior to Officers arriving.  Officers completed a report so that the incident could be followed-up on later.  Just before 1:00 AM, Cape Coral Police Department received another call to the residence-an open 9-1-1 line with what sounded like a domestic disturbance in progress.

As officers arrived, they knocked and announced their presence.  The front door was ajar, and one of the children at the house told officers, “He [Thomas] is here.”  Officers could hear two people arguing in a bedroom.  Seconds later a gunshot rang out and Alexander came running out with an apparent gunshot wound to the chest.  Thomas continued firing rounds towards officers through the interior walls of the house.  Officers were able to get Alexander and 3 of the children out of the home and to safety.

This began a protracted incident between Thomas and officers on scene.  Officers took positions of cover and repeatedly attempted to negotiate Thomas’s surrender.  Thomas would talk with Officers, then fire rounds at them from a pistol and a pump-action shotgun.  In spite of this, Officer Matthew Mills, a 9-year veteran, attempted to maintain a dialogue with Thomas while taking cover.  That was until Thomas, standing partially in the front doorway of the house, pointed a shotgun at officers outside the residence.  Using his department-approved patrol rifle, Officer Mills fired at Thomas, fatally wounding him.  Unbeknownst to Officer Mills, Thomas was holding his infant son, Ray, just outside of view from the doorway.

Thomas fell and withdrew into the residence.  Later, with the assistance of SWAT, Officers were able to make entry into the home.  Ray Thomas was located and taken out of the home and transported for medical treatment of a gunshot wound to the thigh.  Another child was located asleep in the home and was removed for safety.  Rolly Thomas was found deceased in the residence.

The case was investigated by the Investigative Services Bureau of the Cape Coral Police Department and turned over to the State Attorney’s Office.  At the conclusion of the criminal case, the Professional Standards Bureau conducted its internal review of the incident.

The internal review by the Professional Standards Bureau of the Cape Coral Police Department found that:

“Based on the information provided in Detective Bearman’s criminal investigation report, statements from the involved parties, witnesses, Body Worn Camera video, Medical Examiner’s autopsy report, the facts provided by the supervisors, and the statements given by the officers, and in comparison with Department General Orders, it is determined:

  • The exhibition of the firearms were justified and in accordance with training.
  • The firing of the weapon was within departmental policy.”

The review of the officer-involved shooting by the State Attorney’s Office concluded that:

“The totality of the evidence supports the conclusion that Officer Mills was justified in the use of deadly force. Thomas violated a domestic violence injunction for protection earlier in the evening which required the police to be called. Thomas returned after midnight, forced himself into the residence armed with a pistol and axe and shot Marsha Alexander. Thomas committed multiple forcible felonies as defined by F.S. §776.08 to include (but not necessarily limited to) armed burglary (F.S. §810.02(2)(b)); aggravated battery (F.S. §784.045); aggravated stalking (F.S. §§784.048(3) or (4)) and shooting at or within a dwelling (F.S. §790.l0), which could legally fall within the catch-all language of F.S. §776.08. All of the crimes alleged above carry prison sentences with some carrying additional minimum/mandatory sentences pursuant to Florida Statute §775 .087 (2015). The danger presented to innocent civilians and to the assembled police officers lawfully carrying out their duties by the actions of Rolly Thomas justified the use of deadly force by Officer Mills…”

“It is unfortunate that Ray Thomas was also shot in the leg during this incident. Thankfully, the child survived his gunshot wound. The evidence supports the logical inference that Rolly Thomas used Ray Thomas as a hostage.  At approximately 1:28 AM Rolly Thomas appeared in the front doorway holding Ray Thomas and a shotgun.  Rolly Thomas raised his shotgun towards officers outside the residence after having fired his shotgun multiple times within the residence and in close proximity to officers inside and outside the residence.  Officer Mills fired his duty rifle. It must be concluded that Mills felt this was the best opportunity to eliminate the threat that Rolly Thomas posed. The shooting of Ray Thomas does not rise to the level of criminal conduct. Officer Mills lacked mens rea, or intent, to cause great bodily harm against Ray Thomas for the purposes of aggravated battery (F.S. §784.045).  Additionally, given the heightened danger posed by Rolly Thomas’ behavior, it is concluded that Officer Mills did not commit culpable negligence (F.S. §784.05)…Officer Mills was justified in using deadly force in order to quell the dangers posed by Rolly Thomas during the early morning hours of October 24, 2015.  For the reasons set forth above, there is no basis for further action by this office.  This matter should be closed.”

From Interim Police Chief Dave Newlan:

“The actions of Rolly Thomas on October 24, 2015 were nothing short of horrific.  He went to the home that evening armed with a gun and an axe with the intent to kill.  The quick actions of the first officers on scene no doubt saved the lives of Marsha Alexander and the first 3 children rescued from the home.  The officers did everything they could to engage Rolly Thomas and negotiate a peaceful surrender and the safety of the remaining 2 children, even as he shot at them.  Unfortunately, Rolly Thomas chose differently.

Without regard for anyone, Thomas continued his armed assault, pointing a shotgun at officers outside the home, placing them in imminent, mortal danger.  Officer Matthew Mills, a 9-year veteran of the Cape Coral Police Department, was one of the officers faced with this threat that night.  The taking of a life is something we all hope will never happen in our career in law enforcement.  Sometimes the actions of a suspect leave us no choice.  This was one of those times.  Under immediate threat from Thomas and his shotgun, Officer Mills took advantage of a limited tactical window and shot Rolly Thomas as he pointed that shotgun from a partially concealed position in the front doorway of the home.  Officer Mills took the only shot he had.  He did his job and stopped the threat. Unknown at the time, Rolly Thomas was actually holding his infant son, Ray, in one arm as he shot at officers with the other.  Sadly, Ray was injured in the gun battle. Thankfully we were able to get to him and get him medical attention.  Make no mistake, everything that happened that night was the direct result of choices made by Rolly Thomas.

The community was shaken by this tragic incident.  A family was destroyed.  Marsha and Ray will carry the physical scars for the rest of their lives.  An officer was forced to take a life.  The physical and mental healing is underway, but it will take time.  The Cape Coral Police Department will continue to help and support Marsha and the children through our Victim Assistance Unit in whatever way we can.  Officer Mills is back to work, doing what he took an oath to do, with the full support of this Department and this community.”

The victims continue to recover from the injuries they sustained that night.  Officer Mills has returned to full duty here at the Cape Coral Police Department.

ANNOUNCEMENT: Accreditation Team Invites Public Comment About the Cape Coral Police Department

(July 1, 2016)-  A team of assessors from the Commission for Florida Law Enforcement Accreditation (CFA) will arrive July 27, 2016, to examine all aspects of the Cape Coral Police Department's policies and procedures, management, operations, and support services, Interim Chief David Newlan announced today.  

The Cape Coral Police Department has to comply with approximately 84 Comparative Compliance standards in order to receive accredited status.  Many of the standards are critical to life, health, and safety issues.

The Accreditation Program Manager for the Cape Coral Police Department is Det. Jennifer Silko and Accreditation Team Member Cpl. Morgan Mills.  Both said the assessment team that will visit the Cape Coral Police Department is composed of law enforcement practitioners from similar agencies.  The assessors will review written materials, interview individuals, and visit offices and other places where compliance can be observed.

The CFA Assessment Team Leader is Janet Hartman from the Florida Department of Business and Professional Regulation.  Other team members are Sergeant Ronald Concillo from Lauderhill Police Department and Sergeant Vincent Montagud from Port St. Lucie Police Department.

Once the Commission’s assessors complete their review of the agency, they report back to the full Commission, which will then decide if the agency is to receive accredited status.  Cape Coral Police Departments accreditation is for a period of 3 years.

"Verification by the team that Cape Coral Police Department meets the Commission’s standards is part of a voluntary process to gain or maintain accreditation- a highly prized recognition of law enforcement professional excellence," Interim Chief David Newlan said.
